We provide our mediation services to represented and self-represented parties.
The Family Law Rules requires prospective parties to genuinely try to resolve their financial dispute before starting a proceeding in the Court. Family Dispute Resolution is a 'genuine step' in that regard.
We engage in Guided Separation which involves mediation for self-represented parties, led by a legally qualified mediator. Our process includes:
- Detailed intake sessions where we promote party understanding of the legal landscape within which they will make their own decisions;
- Understanding party obligations in their duty of disclosure;
- Preparing for property mediation;
- Referrals to lawyers, accountants, mortgage brokers, valuers and other experts as required;
- Understanding party obligations to take genuine steps in their matter.
Reaching agreement by way of mediation might:
- Assist you make your own decisions
- Greatly reduce the financial and emotional costs of legal proceedings
- Allow you to move forward and make a new life for yourself
- Reduce conflict and possibly improve your continuing relationship
- Improve communication with your former spouse/ partner
If an agreement is reached it can be formalised by either:
- Binding Financial Agreement; or
- Applying to the Family Court Federal Circuit Court of Australia for Consent Orders.
We assist clients in this regard by preparing detailed Heads of Agreement, or when clients are legally represented, Minutes of Consent.
